The Commissioner General of Uganda Prisons Johnson Byabashaija has apologised to Jinja Court chief magistrate Francis Kaggwa for failing to comply with his earlier court order to transfer sickly and elderly suspects in the Kasese killings from Kirinya to Luzira prison.
Byabashaija’s apology was presented to court by his assistants, Natukunda Aliyo and James Kisambu from Luzira legal and health departments .
They explained to court that the earlier orders had never been served to the Commissioner General except the most recent one of February 20, 2017, which he has since complied with.
Meanwhile court has heard that police is still investigating the case allegedly committed by the Rwenzururu King Charles Wesely Mumbere and his royal guards between March and November 2016 within Kasese region, in which over 100 people lost their lives.
The charges include murder, terrorism, treason, robbery, attempted murder and malicious damage to property
Magistrate Francis Kaggwa has now adjourned the case to March 20.
Kitsumbire’s bail application ruling for 14th/March
Jinja High court has also set March 14 to rule on the bail application filed by the Rwenzururu Kingdom Prime Minister Thembo Kitsumbire.
Justice Eva Luswata set the date after hearing Kitsumbire’s bail application Monday morning in which he asked court to temporarily release him from Luzira prison.
Kitsumbire , through his lawyers of Alaka and Company Advocates told court that he is of advanced age and suffers from various ailments which need special attention from home.
Kitsumbire is on remand at Luzira prison on several charges of murder, terrorism and treason among others all related to the March and November 2016 incidences in Kasese district where over 100 lives were lost.
He was charged before Jinja magistrate’s court alongside his King Charles Wesely Mumbere and over 170 royal guards.
