Court to rule next week on 3rd Kanyamunyu bail application

Kampala, Uganda | GODFREY SSALI |  The Director of Public Prosecutions (DPP) has asked High Court Judge Yasin Nyanzi to uphold his earlier decision of denying Mathew Kanyamunyu bail.

Kanyamunyu is accused of behind last year’s Lugogo shooting incident in which Social Worker Kenneth Akena died.

Through State Attorney Immaculate Angutoko, DPP said nothing has changed since the earlier court decision of March 28, 2017 when Justice Nyanzi released on bail Kanyamunyu’s co-accused Cynthia Munwangari and Joseph Kanymunyu.

Court then declined to release him on grounds that there was strong evidence pointing to him as being at the centre of the alleged murder.

The DPP still maintains that this evidence is sufficient enough to convict Kanyamunyu who is facing a charge of murder that carries a maximum sentence of death upon conviction.

And that its this evidence that was availed to him at Nakawa Magistrate Court upon committal, that will compel him to abscond if released on bail.

Now this combined with other factors of failing to prove exceptional circumstances of grave illness and old age, the DPP asked court to dismiss his application so that society is protected from lawlessness.

This is the third attempt for Mathew Kanyamunyu to apply for bail before the High court.

He is alleged to have shot dead Akena on November 12, 2016 along Kampala Jinja -Highway after the deceased car knocked his car.

Justice Nyanzi sent Mathew Kanyamunyu back on remand to Luzira Prison until August 23 next week when he will deliver his ruling.
